These Terms of Service (“Terms”) govern your access to wearecantera.shop and purchases from Cantera, a trading name of YOGA LTD.

Please read these Terms before using the website or placing an order. Our Shipping Policy, Returns & Refunds Policy and Privacy Policy also apply where relevant.

1. About Cantera

Cantera is an online women’s activewear and athleisure retailer serving customers in the United Kingdom.

2. Acceptance of these Terms

By using the website or placing an order, you agree to these Terms and the policies linked above. If you do not agree, you should not use the website or place an order.

You must be at least 18 years old and legally capable of entering into a binding contract to place an order. You must provide accurate information and use the website only for lawful purposes.

3. Using the online store

You must not:

  • Use the website or its products for an unlawful or fraudulent purpose
  • Attempt to gain unauthorised access to the website, customer accounts or connected systems
  • Introduce malicious code, viruses or other harmful technology
  • Interfere with the security, availability or proper operation of the website
  • Scrape, harvest or collect another person’s information without lawful permission
  • Infringe Cantera’s or another person’s intellectual-property, privacy or other legal rights
  • Submit false, misleading, abusive or unlawful content

We may take reasonable steps to protect the website, customers and business where misuse or a security risk is identified.

4. Products and descriptions

We take reasonable care to present product descriptions, dimensions, materials, colours, images and other information accurately using the verified information available to us.

The appearance of colours may vary slightly according to screen, device and display settings. This does not affect your rights if an item does not match its description or is faulty.

Product measurements and sizing information are guides. Please review the information shown on the relevant product page before ordering.

Products, colours, sizes and other variants are subject to availability. We may update product information to correct errors or reflect verified changes, but changes will not retrospectively alter an order already accepted unless required by law or agreed with you.

5. Placing an order and contract formation

When you submit an order, you are offering to purchase the items in your basket under these Terms. The automatic order acknowledgement confirms that we have received your order; it does not mean that the order has been accepted.

The contract for an item is formed when we send the dispatch confirmation for that item. If an order contains items dispatched separately, a separate contract is formed for each item when its dispatch is confirmed.

Before dispatch confirmation, we may decline or cancel an order for a genuine reason, including:

  • The product is unavailable
  • Payment is not authorised or cannot be verified
  • Delivery or contact information is incomplete or materially inaccurate
  • The displayed price or product information contains an obvious error
  • Fraud, misuse or an unlawful transaction is reasonably suspected
  • We cannot deliver to the address provided

If we cancel an order after payment has been taken, we will refund the amount due to the original payment method without undue delay. We will not cancel an accepted order merely because we later wish to charge a higher price.

6. Prices, payment and billing

Prices are displayed in British Pounds sterling (GBP). The total price payable to Cantera, including any applicable tax and mandatory charge, will be shown before you submit payment.

Cantera provides free tracked shipping to United Kingdom addresses, with no minimum spend. We will not add a shipping charge at checkout.

Available payment methods are displayed at checkout. Payments are processed securely by Shopify and the applicable third-party payment provider. Cantera does not receive or store complete payment-card details.

You agree to provide current, complete and accurate billing, contact and delivery information. Please contact us promptly if you notice an error.

7. Delivery

Cantera currently delivers within the United Kingdom only. Delivery costs, processing times, estimated transit times, tracking and possible delays are explained in our Shipping Policy, which forms part of these Terms.

Risk of loss or damage remains with Cantera until the goods come into your physical possession, or the possession of a person you identify to receive them, except where you independently appoint a carrier not offered by us.

Delivery dates are estimates rather than guarantees. If an event outside our reasonable control causes a delay, we will take reasonable steps to reduce the effect and communicate where appropriate. Your statutory rights relating to late or failed delivery remain unaffected.

8. Cancelling an order, returns and refunds

Contact support@wearecantera.shop as soon as possible if you wish to cancel an order before dispatch. We will try to stop processing. If fulfilment has already begun or the parcel has been dispatched, we may be unable to stop delivery, but we will record your cancellation request and provide the applicable return instructions. This does not reduce any statutory cancellation right.

Your cancellation, return, exchange and refund rights are explained in our Returns & Refunds Policy, which forms part of these Terms.

Cantera’s voluntary 30-day return policy operates alongside your statutory rights. Nothing in these Terms limits rights that cannot legally be excluded, including rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Consumer Rights Act 2015.

A model cancellation form is provided at the end of these Terms. You do not have to use that form; any clear statement identifying the order and your decision to cancel is sufficient.

9. Promotions and discount codes

From time to time, we may offer a promotion or discount code with additional terms shown with the offer. Eligibility, duration, minimum spend, product exclusions and other material conditions will be presented clearly.

A promotion does not alter your statutory rights. Unless an offer expressly states otherwise, discount codes cannot be exchanged for cash and cannot be applied after an order has been submitted.

10. Intellectual property

Unless otherwise stated, the Cantera name, website text, graphics, original photography, logos, layout and other original website content are owned by or licensed to YOGA LTD.

You may view and use the website for personal shopping purposes. You may not copy, reproduce, modify, distribute, publish or commercially exploit protected content without permission, except where the law allows.

Product names, content and third-party marks belonging to other parties remain the property of their respective owners. Nothing on the website grants ownership of those rights.

11. Reviews and other submissions

If we enable reviews, questions or other customer submissions, you must provide content that is genuine, lawful and accurate to the best of your knowledge. You must not submit content that is fabricated, misleading, defamatory, abusive, discriminatory, infringing or unrelated to the product or service.

You retain ownership of your submission. You grant YOGA LTD a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it in connection with Cantera’s website, products and services. This licence allows us to operate and present the submission; it does not permit us to misrepresent your experience.

We may moderate or remove content where reasonably necessary because it is unlawful, abusive, misleading, irrelevant, infringes rights or exposes personal information. We do not promise to publish every submission and will not create or publish fabricated customer reviews.

12. Third-party services and links

The website is hosted by Shopify and may use or link to payment providers, carriers, advertising services and other third parties. Those providers may have separate terms and privacy policies.

We are not responsible for an independent third party’s website or content merely because we link to it. Nothing in this section excludes responsibility that applicable law places on Cantera for providers acting on our behalf or for your order.

Our handling of personal information is explained in our Privacy Policy.

13. Website availability

We take reasonable care to keep the website secure and available, but do not promise that access will always be uninterrupted, immediate or error-free. We may temporarily restrict access for maintenance, security, technical or legal reasons.

Temporary website unavailability does not affect an accepted order or your statutory consumer rights.

14. Our responsibility for loss or damage

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or both you and Cantera knew it might happen when the contract was formed.

We are not responsible for loss or damage that is not reasonably foreseeable, or for a failure caused by events outside our reasonable control where we have taken the steps reasonably expected of us.

The website and products are supplied for private and domestic use. If you use them for a commercial or business purpose, we are not responsible for business losses such as lost profit, lost revenue or business interruption, to the extent permitted by law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and responsibility under your statutory consumer rights.

15. Suspension and termination

We may suspend or restrict website access where a user materially breaches these Terms, misuses the website, or creates a genuine security or legal risk. Where reasonable, the action will be proportionate to the issue.

Suspending website access does not remove rights or obligations connected with an order already accepted, and does not affect provisions intended to continue after termination.

16. Changes to these Terms

We may update these Terms to reflect changes to our services, providers, operations or legal obligations. The current version and its “Last updated” date will be published on this page.

A change will apply from the stated effective date and will not retrospectively alter an order already accepted unless the change is required by law or you agree to it.

17. If part of these Terms is invalid

If a court or relevant authority decides that part of these Terms is unlawful or unenforceable, the remaining terms will continue to apply. A delay in enforcing a right does not mean that the right has been waived.

18. Governing law and courts

These Terms and contracts between you and Cantera are governed by the laws of England and Wales.

If you live in England or Wales, you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the UK jurisdiction where you live. You retain any mandatory consumer rights that apply in your place of residence.
